Genium360 users

An essential part of our commitment to every member, associate and user of Corporation de services Genium360 (hereinafter “Genium360”) is to respect your right to privacy. The present policy (hereinafter “Policy”) will help you better understand how Genium360 collects, uses, communicates, retains and protects your personal information and the extent of your rights in this regard. It applies to all (current and prospective) members, associates and users of eligible services who have joined Genium360 as well as to users of our website (hereinafter “Website”) located at https://www.genium360.ca/ (hereinafter collectively referred to as “Users”).

Types of personal information collected

For the purposes of the Policy, the term “personal information” refers to any information that relates to a natural person and makes it possible, directly or indirectly, to identify that person. This may include, for example, your name, age, marital status, contact information, e-mail address and information related to your account when you join Genium360, including your professional status. Personal information may also include information collected by electronic means, such as User IP addresses, User identifiers and Website navigation data.

Collection and use of your personal information

Information provided by Users. Throughout our relationship with you, we will collect from you personal information concerning you for the following purposes:

  • Administering our programs and services;
  • Communicating with you to offer you our services and commercial benefits;
  • Determining your eligibility for our services and benefits, establishing your identity and certifying that you have obtained your diploma or equivalency certificate, as the case may be;
  • Designing programs and understanding your needs;
  • Managing User participation in promotions, contests and activities;
  • Sending you Genium360 electronic newsletters and providing you with information regarding Genium360's annual and special general meetings (for Genium360 members), as required by law and/or by Genium360's by-laws, as well as to provide you with important information regarding services obtained;
  • Sending you communications regarding changes to the Privacy Policy or the Service Agreement;
  • Contacting you to fill positions posted on our Job Board;
  • Informing you of commercial benefits offered through our partners or allowing our partners to offer you commercial benefits on an ongoing basis (unless you have exercised your right to withdraw your consent, as described in the Consent section).
  • Processing your job application.

Information collected by electronic means. When you visit our platforms, we may collect information through electronic means such as cookies. This may include information about your visit to our Website, including your computer's IP address and the name of the browser you used, your operating system, your screen resolution, your location, your browser language settings, the number of pages you viewed, the information you entered, the advertisements you saw, etc. We use this data to measure and improve the effectiveness of our Website and to enhance the customer experience. For example, statistical compilations may be made to determine the popularity of our site's pages, the average number of pages visited and the average time spent on the site by each visitor. It is also possible that a cookie may trigger the display of advertisements from our partners if you later use your device to visit an external Website that displays these advertisements  . You can choose whether or not to consent to the use of these cookies by activating settings when you log on to the Website. If you choose not to give your consent or to block cookies in the future, you may not be able to access all or part of the content of our Website.

Submissions. When you use features of the Website that allow you to post messages and content and participate in discussion forums, your submissions may be made publicly available or available to other users of the Website, depending on the features you use.

Disclosure of personal information

When it is necessary to enable you to benefit from the commercial benefits you wish to obtain from our partners, we may communicate personal information about you to our partners and receive personal information about you from them. If you withdraw your consent in this respect, we will not be able to continue to offer you commercial benefits with our partners. We may share your personal information with service providers (for example, Amazon Web Services, GoDaddy, Salesforce, Microsoft, Form Assembly, Google Cloud, PayPal, QuickBooks, Zapier) , in the course of providing our services. In the latter case, we take the necessary measures to adequately protect your personal information by adopting specific contractual measures and limiting the sharing of your information.

Courts or other legal or regulatory authorities may require us to disclose information. We may also disclose certain personal information when we have reasonable grounds to believe that it is reasonably necessary in order to protect the rights, property and safety of other individuals and of Genium360, as permitted or required by law.

Communicating your information outside Québec

Genium360, its suppliers and third parties to whom it communicates information in accordance with this statement may carry out some of their activities outside Québec. When your personal information is disclosed outside Québec, we conduct a privacy impact assessment and put in place contractual commitments to protect the confidentiality of this information.

Retention of your personal information

The length of time we retain information about you depends on your User status, the service or the commercial benefit, and the nature of the information. We have retention standards that meet needs dictated by the User service and by laws and regulations. When we no longer need your information, we securely destroy it.

Consent

In general, we collect, use and disclose your personal information only with your consent. In some cases however, the law provides that we may collect, use or disclose your personal information without your consent (for example, when we are required to disclose your information under a subpoena or court order).

By communicating with us, by voluntarily completing a form with your personal information and by browsing our website, you consent to the collection, use and disclosure of your personal information in accordance with this Policy. Subject to certain legal or contractual restrictions, you may withdraw your consent at any time by contacting us as indicated in the “Contact us” section.

Rights of access and rectification of personal information

You have the right to access and obtain copies of your personal information. It is important to ensure that the personal information Genium360 holds about you is accurate and complete. To update your address and other personal information, login to Genium360 online, go to “Your Profile”, change your information and click “Save” or contact Genium360 at the number listed in the Contact Us section.

Right to withdraw consent

You have the right to withdraw your consent to the use or disclosure of your personal information subject to certain legal or contractual restrictions. When you join Genium360, you can return to your profile at any time and modify your consent, for example, change your communication preferences or unsubscribe from receiving newsletters. Please note that even if you change your communication preferences or unsubscribe from newsletters, Genium360 may still need to contact you to send you communications related to the association’s democratic life, elections and meeting decisions, or changes to the Privacy Policy or Service Agreement. You may however decide to terminate your membership by sending us a written notice.

Protecting your personal information

We limit access to your personal information and store it securely. In addition to the physical and electronic safeguards used to protect your personal information, we have implemented security standards designed to protect our computer systems and your personal information from unauthorized use or access. Employees who have access to your information are trained to ensure its confidentiality.

Changes to this Policy

Genium360 reviews and updates its policies and procedures as necessary to ensure that it complies at all times with applicable rules, regulations and standards, to take into account new technologies, and to address the concerns of its Users. Our privacy policy is therefore subject to change. Where appropriate, we will post the changes on our Website and, if we change the policy in a material way, we will publish a prominent notice to that effect.

Please note that this version of our privacy policy does not alter the substance of the previous version as to how we process such information.
